Warren Newman is Senior General Counsel in the Constitutional and Administrative Law Section of the Department of Justice. He has practiced in the field of public law within the Department of Justice for over 30 years. Mr. Newman is a director of the part-time Master’s Program in Constitutional Law at Osgoode Hall Law School, and teaches or has taught courses in federalism, public law and comparative constitutional law at Osgoode and the Faculties of Law of McGill University, the University of Ottawa and Queen’s University.
Mr. Newman acted as co-counsel before the Supreme Court of Canada in the Senate Reform Reference, the Quebec Secession Reference and the Manitoba Language Rights Reference, as well as in other constitutional cases at trial and appellate levels, including the Potter and Hogan cases on the validity of the Constitution Amendments, 1997 and 1998 and the Lalonde case concerning the future of Montfort Hospital. Mr. Newman was the instructing officer on the drafting of the 1988 Official Languages Act, and also advised the government on the enactment of An Act respecting constitutional amendments in 1996, the Clarity Act in 2000, and the Succession to the Throne Act, 2013. He also appeared before parliamentary committees studying Bill S-4, An Act to amend the Constitution Act, 1867 (Senate tenure) and Bill C-16, which amended the Canada Elections Act to provide for fixed-date elections.
A member of the Bars of Ontario and Quebec, Mr. Newman holds a B.A. in history and political science, a B.C.L. and an LL.B. in civil and common law from McGill University, as well as an LL.M. in constitutional law from Osgoode Hall. He is the author of many articles and book chapters on constitutional principles, as well as of the book, The Quebec Secession Reference, the Rule of Law and the Position of the Attorney General of Canada, published by York University. Mr. Newman received the Deputy Minister’s Award for Professional Excellence in 1989, the Deputy Minister’s Award of Merit in 1997 and the Department’s Award of Distinction in 1998. In 2009 the Bar of Quebec conferred the title of Advocatus Emeritus upon Mr. Newman for his distinguished contribution to the legal profession. In 2012 he received the Queen’s Diamond Jubilee medal in recognition of his work.
